ESR Register Limited offers an online resource to colleges and further education establishments giving them access to its membership list of tutors, lecturers and assessors who successfully pass the audits, spot checks and background checks undertaken by the company. Members also have access to discounted training courses offered from time to time.

The ESR Register has been set up to promote transparency in the education sector. We are not an official government body or accredited scheme.

1.1 By returning your CV, a completed application form, a signed Consent to Data Processing form and your annual fee to ESR Register Limited (“We”, “Us”) you give Us consent to undertake checks and take up references with your previous employers.
1.2 By becoming a member of the ESR Register, you agree to sharing personal information about your qualifications, area of work and availability for work with other Further Education establishments than your current employer, where applicable. You also agree to the outcome of any ESR audit, inspection or spot check of your work being made publicly available to other members and register subscribers.
1.3 Your suitability to join the ESR Register will be reviewed on the basis of your qualifications, experience and current activity as an assessor and Further Education practitioner. We reserve the right to accept or decline membership at our sole discretion.
1.4 We will confirm in writing whether your application has been successful with [_] [SW Note: Please confirm how many days you want to deal with applications] days of submitting your application. Incomplete applications will not be processed.
1.5 Your membership will be based on these terms and conditions (“Terms”)


2.1 Your membership will be valid for 12 months from the date We have received payment and We accept your application. Your membership will automatically be renewed every year on the same date. If you do not wish to renew the membership, you must give Us written notice no later than one month before the renewal date.
2.2 Automatic renewal membership fees shall be due to us on the date of renewal of your membership. The fees will automatically be billed annually to your employer or to the credit or debit card details you provide in the application form, in the amount of the then current membership fee. You must inform Us of any changes in your chosen payment details to ensure We always have the most current information.


3.1 Following the day of your payment, We offer a cooling off period of [_] days in which you can change your mind for any reason and request to cancel your membership with a full refund of your payment. [SW Note: Do you want a cooling off period? We would suggest 14 days.]
3.2 After these [_] days, We have a strict no refund policy under any circumstances.
3.3 We reserve the right to cancel your membership with no refund in the event you:
3.3.1 do not pay any amount due to Us;
3.3.2 in our sole discretion, no longer meet the membership requirement of being a competent member of the further education sector (examples of when We might consider this requirement is not met include, but are not limited to, failing to meet audit standards; falsifying records; persistently failing to attend to duties or being dismissed for gross misconduct). 3.3.3 are not in paid employment for an uninterrupted period of 12 months or more; and

3.4 We reserve the right to suspend your membership if matters which call into question your professional reputation come to our attention.
3.5 If your application is cancelled for any reason due to an error on your side, We reserve the right to ask you to make a new application with no refund on the previous application.


4.1 We may revise these terms from time to time if there are any changes in relevant laws and regulatory requirements; or changes in the business requirements of our clients.
4.2 If We have to revise these terms, We will give you at least one month's written notice of any changes before they take effect.

  During the course of our activities We will process Personal Data (which may be held on paper, electronically, or otherwise) and We recognise the need to treat it in an appropriate and lawful manner, in accordance with the Data Protection Act 1998 (“DPA”)


1.1 We will comply with the eight data protection principles in the DPA, which say that Personal Data must be:
1.1.1 Processed fairly and lawfully.
1.1.2 Processed for limited purposes and in an appropriate way.
1.1.3 Adequate, relevant and not excessive for the purpose.
1.1.4 Accurate.
1.1.5 Not kept longer than necessary for the purpose.
1.1.6 Processed in line with individuals' rights.
1.1.7 Secure.
1.1.8 Not transferred to people or organisations situated in countries without adequate protection.
1.2 "Personal Data" means recorded information We hold about you from which you can be identified. It may include contact details, other personal information, photographs, expressions of opinion about you or indications as to our intentions about you. "Processing" means doing anything with the data, such as accessing, disclosing, destroying or using the data in any way.


2.1 We will only process your Personal Data where you have given your consent, where the processing is necessary to comply with our legal obligations, for our legitimate interests or the legitimate interests of others.
2.2 We will only process "sensitive Personal Data" about ethnic origin, political opinions, religious or similar beliefs, trade union membership, health, sex life, criminal proceedings or convictions, where you have given your explicit consent, or the processing is legally required.


3.1 We will process your data by, including but not limited to:
3.1.1 your name;
3.1.2 qualifications;
3.1.3 the geographic area within which you work;
3.1.4 checking your background and qualifications with relevant accreditation bodies and previous employers; and
3.1.5 receiving payment for our services
3.2 Your Personal Data will be made available online, in a register accessible to subscribers to our services (potentially including your past and present employers) and shared with third parties as stated at paragraph 9 below.

  We will keep the personal data We store about you accurate and up to date. Data that is inaccurate or out of date will be destroyed. Please notify Us if your personal details change or if you become aware of any inaccuracies in the personal data We hold about you.


  We will keep your personal data for a maximum of two years after your Membership has ended, when it will be destroyed or erased from our systems if it is no longer required, or when We will inform you in writing of any extension required to satisfy any legal requirements or our legitimate interest.


7.1 You have the right to:
7.1.1 request access to any personal data We hold about you;
7.1.2 prevent the processing of your data for direct-marketing purposes;
7.1.3 ask to have inaccurate data held about you amended;
7.1.4 prevent processing that is likely to cause unwarranted substantial damage or distress to you or anyone else; and
7.1.5 object to any decision that significantly affects you being taken solely by a computer or other automated process.


8.1 We will ensure that appropriate measures are taken against unlawful or unauthorised processing of personal data, and against the accidental loss of, or damage to, personal data.
8.2 We have in place procedures and technologies to maintain the security of all personal data from the point of collection to the point of destruction.
8.3 Maintaining data security means guaranteeing the confidentiality, integrity and availability (for authorised purposes) of the personal data.


  You hereby consent to our sharing your personal data with third parties including but not limited to Further and Higher Education establishments, the Skills Funding Agency or any subsequent public body charged with improving and developing skills in the UK, and any other relevant government or local authority department responsible for Further or Higher Education provision.


  If you wish to know what personal data We hold about you, you must make the request in writing, with an accompanying fee of £10.
